THE NSW Government has told the Roads and Traffic Authority to ensure toll-road operators pursue drivers who do not pay, even though the private companies are not legally bound to do so.

The Premier, Morris Iemma, admitted yesterday that drivers had a right to be angry that no fines were issued for failure to pay the toll on the Cross City Tunnel or the M2 last financial year.

His comments came as both motorways warned motorists not to try to use the roads for free.

Mr Iemma said the Roads Minister, Eric Roozendaal, and the RTA would take up the issue with the motorway companies, as failure to pursue evaders sent a poor message to their customers.

"It's not fair on the drivers who are doing the right thing and paying the tolls," Mr Roozendaal told 2UE. "I wouldn't be surprised if it caused a lot of anger.

"I am concerned the private toll operators are not treating all motorists equally and fairly. I have asked the RTA to contact [them] to make sure this no longer occurs."

It is understood private toll operators are not legally or contractually bound to chase toll evaders, and whether to do so is a decision for each company.

An RTA spokesman said that under the terms of the agreements with the operators of the Cross City Tunnel and the M2, the pursuit of unpaid toll revenue was a matter for the operators.

An industry source said pursuing fare evaders was not in the financial interests of toll companies because most of the cost of this could not be recouped. Most people did pay the toll.

A spokeswoman for Transurban said it acquired the M2 early last year and was still setting up an enforcement system. The company would move to request penalty notices, and it wanted to see those who refused to pay the fines pursued through the State Debt Recovery Office or the courts.

CrossCity Motorway said it had given motorists "reasonable opportunity" to pay for tunnel trips if they had not done so. Evaders had been sent an initial reminder. "After receiving this notice many motorists have already paid the toll," the company said. "If some refuse to meet their obligations, then further infringement notices will be generated.

"Motorists that travel through the [tunnel] without making an effort to pay will be pursued." It did not say when it would start pursuing evaders.
